North Mississippi Delta / Alabama Gulf Coast | We had the same issue when I was working with earbuds and cigarettes.
My rule was, company provided OSHA ear and eye protection and required both when running saws.
Our jobs were in and around customer homes. NO SMOKING on job or in company trucks (General Mgr rule, they did anyway).
My rule was-
I hired you because you have two hands to work. Using a phone for personal calls/text and smoking used one of your hands so you do half as much work.
I would and did write them up but boss let it slide (unless he smelled smoke in truck, always got pizzed about it).
I wrote up my asst mgr many times about this, but I was just a hard azz according to coworkers.
After 17 years, I had to retire due to injuries in an off work ladder fall and boss and asst took over my job.
Less than 1 year later, boss fired and asst dismissed for failing drug test. Corporate took over and released most of the trouble makers and offered me big bucks to come back and manage store. That store went from #3 of 72 store business to non profitable in less than a year! WTH??
Thankfully, I declined.
