SE Nebraska | You are in Nebraska as am I. The law states you share the obligation of a fence and if your neighbor wants a fence, you have no choice but to pay and maintain half of it (the right hand half as you are looking at your line, and you are to maintain and remove trees growing in the fenceline). Sounds like you and your son share a fence line with this owner/tenant so technically you and your son should be building and maintaining HALF of the fence.
