| It is illegal, but unlikely that a farmer would get in trouble from buying bulk commodity wheat from a grain elevator and using it for seed. If any of the varieties of wheat in the mixture that come out of the spout are PVP protected, and a farmer plants them, then he is violating seed law. It does not matter that the farmer does not know what varieties are in the mix. Varieties can be easily identified with genetic testing. This is also true when a farmer sells "feed" wheat to another without identifying the variety, then the wheat is used as seed. | |
