PVP is Plant Variety Protection. I am no lawyer, but the elevator may be partially liable if they suspect the farmer may use the grain for seed and sell it to him anyway. For example, in ND an elevator can reasonably expect that a farmer is not going to feed $20+/bu durum to his cattle. The farmer is definitely liable and would have to pay damages if he has a protected variety on his farm, but has no record or seed tag showing that he purchased that certain variety, no matter how it was obtained (an exception may be if the seller loaded the wrong variety on the truck). I will repeat that it is very unlikely that a farmer would get caught, I just want to point out that it is wrong and is a form of theft. Most of the time, buyers and sellers get caught because someone didn't keep their mouth shut. A field sample would only be taken if there was a strong suspicion of wrongdoing.
