With it being out of the warranty period, you have unfortunately entered that gray area, which means you are stuck with how well the dealer is willing to fight for you. I haven't had to deal with this type of a problem with a vehicle, but have with machinery. In those cases it took several meetings with the block representative along with pressure from the dealer.
