I'd say the police is in a "world of hurt". By him telling the driver it is OK with an escort, I'd say that removes liability from the unlicensed driver. Driver should be ticketed for invalid license and tags but everything after the "stop" falls on the officer.
Now, if you want to talk about "common sence", I'd say they both need a little time at the funny farm.
I think we had a similar situation locally where a local "Barney Fife" was escorting an ennebriated driver (as a favor after being pulled over) a few short blocks to home and the driver had an accident during the escorted trip. I am not sure how this ever worked out but I doubt the police department are doing any more of these types of favors. | |
