The codified IL statues say ‘a just proportion’ and the courts have ruled that if you don’t have livestock the fence is not on you, it’s the guy who has livestock.  If the fence fails from neglect/disrepair, you can get damages.  If the fence fails because the creek floods, that is just life and things happen.  If the neighbor builds a nice fence and then you start using it for livestock the neighbor can come back on you for half.  

The ‘right hand rule’ is less a hard rule and more a commonly applied tradition for maintenance responsibility of a shared fence.
