Subject: RE: THC Questions

Conger, MN

This company (Batch) is based in Milwaukee, and it was started by three UW Madison grads. They manufacture their own CBD products in their Milwaukee facility. They are derived from hemp grown by a producer in Wisconsin.

The owners and the hemp farmer are shown here:

If you are asking about THC . . . I don't think that is legal in Wisconsin unless it is prescribed or meets some pretty strict specifications. The Batch owner that I met explained that they are not making anything with THC because the law is such that if there is a mistake in manufacturing, and your THC level is even a bit to high, you could be out of business.

I don't know if the law has changed since then, but here is info on the nuances of the Wisconsin law in 2021:

The legality of delta-8 THC, when converted from hemp-derived CBD, depends on whether it meets the
definition of “hemp” or, instead, constitutes synthetic or chemically synthesized THC. In order to meet
the federal and state definitions of hemp, a substance must: (1) be any part of the cannabis plant,
including the seeds thereof and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of
isomers; and (2) have a delta-9 THC concentration of 0.3 percent or less. However, synthetic THC
remains a controlled substance under federal and state law, as highlighted by the DEA’s interim final
rule, though controlled substances laws do not define the term “synthetic.”
