Subject: RE: Deadly Crash

Conger, MN

An interesting question that may play out in this case is:

What legal responsibility does the owner of the vehicle have? (Assuming the car is not titled in the 17 year old's name -- in most states, a kid has to be 18 to title and register a car in the kid's name.)

If the car is titled in a parent's name, there is no doubt that the vehicle's insurance will apply. (In most cases, anyone given permission to drive would be covered by the policy -- and if the 17 year old lives with the parent(s), then the household coverage would apply.)

In all likelihood, the girl owns very few assets of her own. Thus, the insurance would policy would be exhausted, and the claimants will need to look to other policies for coverage.

One likely target is the parents: do they have an umbrella policy? Are they wealthy enough to make a contribution to the settlement funds? Were they negligent in allowing the daughter to drive (sticker's not going to help them) -- or can a claim be made that they were negligent?

Certainly, the loss of life and the injuries are the biggest concerns. However, lots of insurance questions will be asked in the coming days.
